Condo Industry Update: Legalization

At recent AGMs for many of our condo corporation clients, a hot topic of debate has been issues surrounding the legalization of marijuana within common element areas and individual units

Issue: marijuana usage with the condominium

As a result of Canada’s legalization of marijuana, boards, property management and individual unit owners/leases are scrambling to determine how to navigate the appropriate response to marijuana and other smoking within condo communities.

Going-forward: ask the right questions

Various plans have been implemented regarding the navigation of legalization. Condominium board of directors should speak to their legal representatives to understand various options they have regarding marijuana, tenant’s rights, bylaws, human rights etc.
